Daubert Reliability Test Compliance
BioFunction®’s Evidentiary Forensic Disability Examination™ is designed to develop factual, objective and scientific data and evidence of an injured claimant’s ‘true’ physical functional performance capabilities for the medical-legal community. To accomplish this goal, and as a cornerstone examination method, we use the industry’s most sophisticated and precise instrument, the ERGOS® Work Simulator, for gathering and measuring physical performance capabilities.
In order to ensure maximum assurance to our clients that the information gathered, and methods used, by the ERGOS® Work Simulator meet the “Daubert Reliability Test” standard for admissibility of scientific evidence the following is presented:
Scientifically Tested – The testing protocols and methodologies used by the ERGOS® Work Simulator have been extensively studied for validity, reliability, reproducibility, clinical and longitudinal predictive capabilities. The ERGOS® is backed by more than 70 years of research with the basis of its science documented in over 2,000 publications;
Peer Review – The ERGOS® technology has been subjected to independent peer-review and publication by independent unpaid researchers, and complies with all government and industry standards for measuring work performance;
Error Rate – The ERGOS® Work Simulator’s test protocol methodologies have been researched for inter- and intra-rater reliability demonstrating an acceptable reliability error rate and reproducibility of results; and
Scientific Community Acceptance – The methods of analysis used by the ERGOS® technology are “widely accepted” by the scientific and medical community as "the most comprehensive" type of work capacity examination available in the industry today.
