Is An Evidentiary Forensic Disability Examination The Same As A Functional Capacity Evaluation?

The answer to this question is a resounding….NO!!

flex.jpgFunctional capacity evaluations involve five different types of hierarchical physical assessment processes (face validity & normative testing) of increasing complexity, time and expense that may, or may not, conform to verifiable, defensible and objective scientific evidence standards.

An Evidentiary Forensic Disability Examination is a comprehensive med-legal examination combining advanced technology based physical performance testing (criterion based construct testing), that meets or exceeds scientific “gold standard” compliance requirements (regardless of the manufacturer) AND adds multiple physio-behavioral factoring tests to establish and document a defensible “preponderance of medical evidence” for a court of law, disability ruling and / or “tertiary” case closure determination.

What Does "Preponderance of Evidence" Mean?

Preponderance means that evidence, in the judgment of the juror, is entitled to the greatest weight, appears to be more credible and convincing to the mind, has greater force, and overcomes not only the opposing presumptions, but also the opposing evidence.

What Does "Forensic" Mean?

The use of the term "forensic" relates to the use of science or technology in the investigation and establishment of facts or evidence in a court of law

What Is Factoring & Factorization?

In short, "factoring" is objective science. Factoring represents the most exacting scientific method available for objectively collecting data of any kind and it holds that the greater the number of factors identified, collected and measured, the greater the reliability and accuracy of its conclusions.

Factorization is the systematic classification of independent factors (finding and characterizing primes), that when weighted values of measurement (computational algorithms) are applied, a definitive causal conclusion (factoring algorithms) can be reached regarding the nature of the object being measured.
